Ordinance (1) amending Section 2B.11 of the San Francisco Administrative Code to (a) replace the existing fee schedule for preparation of written findings of fact in assessment appeals with a fee that recovers the costs attributable to the preparation and issuance of findings by the Assessment Appeals Board, (2) making findings relative to the City's costs of preparing written findings of fact in assessment appeals, and (3) making findings pursuant to the California Environmental Quality Act, Public Resources Code Section 21080(b)(8)(A), that the fees for written findings are not a "project" and that such fees are imposed for the purpose of meeting operating expenses, including employee wage rates, fringe benefits and other direct and indirect overhead charges attributable to the preparation and issuance of such findings. Requesting/Inquiring: In light of recent events at the Building Inspection Commission, Supervisor has suggested that all Commissioners, and particularly Commission Presidents work with Sheriff Hennessey and his staff to ensure that protocol and procedures for public meetings are followed, and that all such meetings are conducted with decorum.
The Sheriff is willing to make available deputies in the instance that commissioners are concerned for safety, and for the respectful conduct of business. We would encourage commissioners to contact Sheriff Hennessey's office at 554-7225 to seek training.

Requesting/Inquiring: To analyze cost increases of the 10 largest non-profit agencies contracting with the Department of Public Health and the Department of Human Services, to determine their fixed cost increases over the past four years, such as workers' comp, retirement and health benefits, rent and lease expense; and to provide a report to the Budget Committee in time to be considered during the budget hearings.

Requesting/Inquiring: To conduct traffic studies at the intersection of Sawyer and Visitacion in Visitacion Valley and return with recommendations about improving pedestrian safety at this intersection. Many drivers turn on to Sawyer from Geneva and use it as a thoroughfare to travel into the Valley. Although there are four way stop signs at this intersection, it is often ignored by drivers and many of the residents in this area fear for their safety when crossing the street.
There are a number of disabled citizens in this neighborhood, the community would like a traffic signal at this intersection. We believe that any mitigation to this area will be helpful to the residents. Supervisor Maxwell requests that the department contract her office in one month with the recommendations.

Requesting/Inquiring: To answer the following questions regarding the employment termination of the 7514 General Laborers, represented by the Laborers' International Union Local 261 – unresolved concerns exists regarding allegations over unfair labor practices causing that the General Laborers were dismissed as a result of creating a "special" program class known as the 7501 position. It is also requested that the Civil Service Commission conduct a formal hearing supported by the Office of Controller in determining any nexus between unfair hiring practices and the displacement of the General Laborers. This is a time sensitive request due to the probable concern that job classification 7514 will be eliminated as of July 2005.

In support of the above query, answers to the following questions are requested:

  1. The examination questions and responses to both the performance and verbal examinations for all hired as well as all General Laborers laid off in November 2004.
  2. The verbal examination scores for all examinees.
  3. The applications of those who were hired to the permanent 7514 position as well asof those General Laborers who were laid off in November 2004.
  4. The names of the parties who took part in the hiring process as well as the procedures these parties followed in reviewing and verifying applications to determine those to be hired.
  5. The names of those who took part in formulating and administering the examination questions.
  6. The policies and procedures which allowed for the verbal examination and the names of all those who took part in requiring the verbal examination.
  7. The policies and procedures which led to the performance evaluations being omitted from the hiring process and which led to a stagnant evaluation process as well as the names of all those who required the stagnant evaluations.
  8. The names of the supervisors of all those hired to the permanent 7514 position as well as those General Laborers laid off in November 2004.
  9. The performance evaluations of those hired to the permanent 7514 examination as well as of all those General Laborers laid off in November 2004 for the time period each were employed with the City.
  10. The type of work performed by the 7514 and 7501 workers and the salary paid for each position.
