080379 [Regulating the conditions for purchasing prior public service credit through the Retirement System]
Ordinance amending Administrative Code Sections 16.55-1 through 16.55-4 and 16.61-5 to allow miscellaneous members of the San Francisco Employees' Retirement System to purchase credit for prior public service at any time before retirement, to require the Retirement System to calculate the cost to purchase that service credit based on the normal cost percentage for that service as determined by the actuary, to require the member to pay for all of the normal cost for the service credit, to allow eligible members to choose to receive prorated service credit if they terminate an installment agreement to purchase prior public service, to allow the Retirement System to accept rollovers to pay for public service purchases, and to conform to changes in the applicable law and Retirement System practices. Requesting/Inquiring: Rather than proposing a run of the mill trickle down stimulus package to ensure the continued viability of our local economy, why not one that trickles up? An Earned Income Tax Credit that cuts them a check for up to $4,000 for families making less than $42,000 a year and qualifying even if they pay no taxes- it's not a tax refund it's a credit. Families can now get this credit under a program call Advance Earned Income Tax Credit (AEITC). It's a better stimulus idea because the money is available for working families immediately, before the holidays. Importantly, these folks, at this time of year, are the most likely to turn around and spend it in our local economy, not like the beneficiaries of trickle down stimulus packages who are more likely to spend it on that trip or that real estate development in Hawaii. Stimulus proposals too often ignore workers, or in the latest incarnation even middle class people, except as a marginal group who may or may not benefit from the knock on effects of a conventional stimulus package. The IRS runs the Advance Earned Income Tax Credit (AEITC) program, and to what extent this concept could be applied to, or incorporated within, any local stimulus package on the table is worth investigating.

Requesting/Inquiring: Requesting the City Attorney to draft legislation implementing the following goals:

  1. If a proposed project is located within the area covered by the 19th Avenue Interim Controls and in an area covered by Section 311 (residential zones) or Section 312 (neighborhood commercial zones) and would otherwise require a mailed notice, notice and plans shall be mailed to both property owners and tenants at least 30 days before the Conditional Use hearing. The Radius for notices shall be the same as for a Conditional Use.
  2. At a hearing at which a Conditional Use is approved, the Planning Commission shall schedule a hearing on the status of construction or operations under the Conditional Use three years from the date of approval, or such other time limit imposed by the Commission for taking out a permit or commencement of operations.
  1. The Zoning Administrator shall cancel the later hearing if the project is under construction or if the project is operational within the relevant time period.
  2. If construction is not underway and the project is not operational, the possible revocation of the Conditional Use shall also be placed on the Commission agenda at the time of the hearing.
