Requesting/Inquiring: One of the Planning Commission's recommendations regarding BF # 07-0671 is that DBI permit review staff will need to receive training on fringe financial services so that any such application will be appropriately routed to the Planning Department for review.

Within 30 days, please clarify how DBI and Planning intend to modify their procedures and communications to ensure that both conform to what is expected of the departments as outlined in the ordinance.

Requesting/Inquiring: The Bureau of Street Environmental Services, a Division of the DPW, is in charge of maintaining city owned street furniture. MUNI is in charge of maintaining MUNI poles. The banner hardware on the decorative light poles on Mission Street, between 16th and 24th is sorely neglected.

These poles are a prominent and highly regarded contribution the city has made to our famous, busy corridor. There are numerous either broken or missing banner brackets.

One or both agencies must take responsibility for maintenance and repair of this city owned street furniture. Community activists have been calling DPW and MUNI for years and getting nowhere. The 30th anniversary of Carnaval SF, the Mission's signature event, is in May of 2008. We expect the problem to be fixed before this event.

Within 30 days, we would like a written action plan detailing which city agency will be responsible for the continued maintenance of said street furniture, and when our community can expect the repairs to begin, and be completed in full.

Requesting/Inquiring: According to the City's "Blue Book" street construction directives, Sec. 8.1, sub-section C states, "Plates shall be coated with non-skid product."

  1. Does DPW really monitor these street construction sites on a regular basis?
  2. If so, do the inspectors take seriously the directive that construction plates "& shall be coated with non-skid product"?
  3. If "Yes" is the answer to the above questions, why is there such an extreme prevalence of plates without non-skid product on sites throughout the City?

Plates without tread are extremely hazardous for anyone on 2 wheels, and DPW's lack of contract oversight in this regard has already resulted in numerous serious injuries, endangering both the citizenry of San Francisco and putting the City in a situation of great legal liability for no good reason.

What will DPW do differently going forward to make sure that this code section is enforced without exception? What penalties does DPW suggest be levied to ensure that contractors do not continue to ignore the law, and how will DPW change its enforcement regime to ensure that this problem be fixed permanently?

Requesting/Inquiring: Over the last several months, the conditions around 19th and Lexington have become increasingly dangerous. Most recently, this weekend the bouncer of a well-liked bar on the corner was hit in the leg by a stray bullet.

I understand from the Police and from neighbors that there are a few gang members who live in the building where the bar is located, and that this core group attracts as many as a dozen loitering gang members on an almost daily basis whom either draw or return gunfire from rivals on a regular basis. As many of my constituents have pointed out, this situation would not stand if it were occurring in the Marina, period.

It is unfair and unbelievable that such a small group of violent people can hold a neighborhood hostage with fear. I am tired of hearing from neighbors that the Police blame the Board of Supervisors and the terrified neighbors lack of assistance for the City's inability to solve the problem; this is insulting and patently false. We make sure law enforcement has all the tools and resources they request to do their jobs, and we want to see some results now.

Within 30 days, I would like a written response form all of the above mentioned city bodies detailing what the coordinated response will be to this situation and to the crisis of confidence in the city's ability to ensure public safety, and how my office can be of assistance to facilitate a resolution to this very grave problem.
