The Board of Supervisors of the City and County of San Francisco met in regular session on the above date with President Tom Ammiano presiding.

The meeting was called to order at 2:01 p.m. On call of the roll, the following Supervisors were noted absent:

Supervisor Becerril indicated she intends to move to table the Chinatown Area Plan resolution, File 000023, when the matter is called before the Board today. (See infra.).

Supervisor Teng introduced, welcomed and presented a commendation to Claudine Cheng for her involvement in promoting the United States Postal Service commemorative stamp for the lunar calendar Year of the Dragon, noting how appropriate that the Dragon begins the new millennium year.

Ms. Cheng thanked the Board of Supervisors for the recognition.

CONFERENCE WITH CITY ATTORNEY - Anticipated Litigation as Defendant
992195 [Anticipated Litigation] Supervisor Newsom
Motion that the Board of Supervisors convene in closed session with the City Attorney for the purpose of conferring with, or receiving advice from, the City Attorney regarding anticipated litigation (City anticipated to be a defendant) which may be filed as a result of the decision of the U. S. Court of Appeals for the Ninth Circuit, Lindsay v. Tacoma Pierce County, No. 98-35416, which concluded that the regulation of outdoor tobacco advertising by the Tacoma Pierce County Health Department Board of Health is preempted by the Federal Cigarette Labeling and Advertising Act. The City and County of San Francisco has local laws regulating certain tobacco advertising. This closed session would be permitted by Government Code Section 54956.9(b).

(The City Attorney advises that, as of January 6, 2000, the City has not been threatened with litigation regarding this issue. Government Code Section 54956.9(b), and City Administrative Code (Sunshine Ordinance) Section No. 67.8 would not permit a closed session, unless the City receives such a threat by January 10, 2000.)

Motion that the Board of Supervisors convene in closed session with the City Attorney for the purpose of conferring with, or receiving advice from, the City Attorney regarding the following existing litigation in which the plaintiffs and claimants, various businesses, are, in sum, challenging the constitutionality of the City’s business taxing system. These plaintiffs and claimants are also seeking reimbursement of tax payments made to the City: General Motors Corporation v. San Francisco, and related cases and claims. This closed session would be permitted by Government Code Section 54956.9(a).
