The parameters of the legislation shall include the following:

1. The Planning Code shall be amended to require that all office development projects in excess of 50,000 gross square feet shall include ten percent (10%) of their usable floor space for the exclusive use of non-profit organizations established under Section 501 (c) (3) of the Internal Revenue Service Code which are community services and further that community services shall be defined as a non-retail use which includes executive, technical, management, clerical and administrative support for the provision of social, health, housing, employment, economic, legal, cultural or arts services to the general public, principally to persons of low and moderate income.

2.This inclusionary space shall be devoted for a period of not less than 50 years to non-profit uses.

3.Additional office development shall be granted additional square footage equal to the amount of space so devoted to non-profit uses over the allowable Basic Floor Area requirements for that site and shall be exempt from the requirement of acquiring Transfer of Development Rights for that additional space, however the limitations on Floor area established in 123(c) (2) shall not be exceeded.

4.The additional space shall be subject to all mitigation fees, specifically fees for transit, affordable housing, child care and downtown parks, but shall not be counted against the annual limit on office development established in Section 321.

5.This inclusionary space for non-profit uses may be provided either on site or at
