The Board of Supervisors of the City and County of San Francisco met in regular session on the above date with President Barbara Kaufman presiding.

[Owner Move-In Reform-Senior Housing Protection II]
Ordinance amending Chapter 37 of the Administrative Code by: (1) amending Section 37.9(a)(8) governing evictions for owner or owner-relative move-in ("OMI") to require that the owner/relative move into the property within three months and live in the property for 36 months, to require a 50% or greater ownership interest in order to evict under OMI as to owners acquiring rental property after July 1, 1997, to limit evictions for owner’s relatives, to prohibit OMI eviction if any comparable unit owned by the landlord is vacant and available prior to the tenant’s vacation of the unit; (2) adding Section 37.9B to require owner documentation for OMI evictions, to provide rights to tenants evicted under OMI including a three-year right of re-rental and limitations on rent increases, and to provide a right to relocation costs for tenants of 12 months or more in multipleunit buildings; (3) amending Section 37.10A to make it a misdemeanor for an owner to refuse to rent to a senior-age person because that person would acquire rights under this chapter; and (4) amending Section 37.11A to provide a right of civil legal action against an owner who attempts to prevent a person from acquiring rights under this chapter. Resolution authorizing the Department of Public Health, Community Substance Abuse Services, to enter into a Combined Negotiated Net Amount and Drug Medi-Cal Agreement for the term July 1, 1998 through June 30, 1999 with the State of California, Department of Alcohol and Drug Programs in the amount of $15,986,354 as a condition of receiving state funds for substance abuse treatment; holding the State Department of Alcohol and Drug Programs harmless from any and all claims resulting from the agreement; authorizing and designating the Director of Community Substance Abuse Services to sign said agreement and to approve contract amendments for less than ten percent (10%) of the contracted amount. There being no objection, the Board directed the Clerk to comply with the following requests: By Supervisor Newsom, that letter of inquiry be sent to the Office of Citizen Complaints inquiring about the number of complaints received on the topic of Critical Mass and about their follow-up procedures, to the extent such actions may be discussed. By Supervisor Ammiano, that letter of inquiry be sent to the Sheriff requesting updates on efforts to repair showers in the C Pod of the Jail at 425 Seventh Street until the repairs have been completed and whether anything can be done to expedite repairs. By Supervisor Ammiano, that the City Attorney provide copies of documents related to the City Attorney’s investigation of the Alemany Farmer’s Market within five business days of this request. By Supervisors Ammiano, Katz, that the City Attorney, in consultation with the Director of Public Health, draft legislation that would allow City employees who are caring for an immediate family member or domestic partner with a catastrophic illness to accept donations of sick leave or vacation credits from other City employees. By Supervisor Katz, that the City Attorney investigate allegations of sexual orientation discrimination, wrongful termination, intentional infliction of emotional distress, negligence and defamation, made by employees of Personal Protective Services, a security contractor hired by the San Francisco Housing Authority pursuant to the Administrative Code, which allows the denial of City contracts to companies that discriminate based on sexual orientation. By Supervisor Katz, that the City Attorney prepare legislation to amend Chapter 39 of the Administrative Code (Integrated Pest Management Policy) to include antimicrobial agents. The extent of the inclusion is define in materials from the Commission on the Environment.
