The Board of Supervisors of the City and County of San Francisco met in regular session on the above date with President Tom Ammiano presiding.

The meeting was called to order at 2:06 p.m. On call of the roll, the following Supervisors were noted absent:

Supervisor Kaufman moved to amend the title, line five, after "Buchanan Street" by inserting "and approving granting a conditional use permit subject to conditions imposed by Planning Commission and additional conditions imposed by the Board of Supervisors";

amend line 18, after "disapproved" by inserting "; and, be it

FURTHER MOVED, That the Board of Supervisors approves granting a conditional use permit subject to conditions imposed by the Planning Commission by its Motion No. 14824, dated May 13, 1999 with the following two conditions being added by the Board of Supervisors:

1. No pharmacy shall occupy the ground floor retail spaces.

2. The grant of the condition use authorization to exceed the lot size limited is subject to the grant of deviations from the rear yard requirements by the Board of Appeal; and, be it

Resolution urging the City Attorney and the Department of Telecommunications and Information Services to monitor legislative, regulatory and judicial developments in the California Legislature, Congress, the Federal Communications Commission and Federal Courts addressing access to high-speed cable and other high-speed broadband networks; to take all possible action to ensure that Congress, the Legislature and/or the Federal Communications Commission adopt policies that protect consumers’ access to a choice of Internet and other on-line service providers and to all forms of information over the Internet and over high-speed broadband networks; and to support the authority of cities to require cable companies to provide non-discriminatory access by unaffiliated Internet and other on-line providers to the broadband cable network by filing an amicus brief in support of the City of Portland’s open access requirement in the United States Court of Appeals for the Ninth Circuit.

Resolution establishing city policy supporting open non-discriminatory access to broadband access services and supporting non-discriminatory access by consumers to all content on the internet;
urging the San Francisco City Attorney, the Department of Telecommunications and Information Services and the Telecommunications Commission to take all possible action to implement this policy at the federal, state, and local level by: 1) monitoring legislative, regulatory and judicial developments in the California Legislature, Congress, the Federal Communications Commission and Federal Courts addressing high-speed internet access; 2) monitor the market for broadband access services in order to gauge the necessity or feasibility of imposing an open access requirement; 3) requiring cable companies and other providers of high-speed internet access services to permit unrestricted access to all content on the internet in addition to allowing subscribers a singe "click through" directly to such content; 4) requiring cable companies and other providers of high-speed internet access services to provide universal access by consumers to any cable modem or high-speed internet access service in a service area in which cable modem or high-speed internet access service is offered; 5) filing an amicus brief in support of the City of Portland’s non-discriminatory access requirement in the United States Court of Appeals for the Ninth Circuit and; 6) urging the San Francisco City Attorney, the Department of Telecommunications and Information Services and the Telecommunications Commission to report back to the Board of Supervisors by December 15, 1999 on federal, state and local legislative, regulatory, judicial and technical developments and recommend a course of action for the City.

Resolution urging the California Legislature to amend the State’s electric deregulation law, Chapter 854 of 1996, Sections 366(A) and (B) to authorize San Francisco and any other California municipal corporation, upon a majority vote of its governing body or registered voters, to designate itself as the automatic aggregator of electricity on behalf of its residents and businesses, such that residents and businesses shall be automatically included in the jurisdiction’s community aggregated electricity buyers’ group, unless exercising a choice for the existing electrical corporation or another provider.
Supervisor Ammiano requested this item be continued to August 2, 1999.

Supervisor Ammiano moved the following amendment to Section 25.1:

"Section 25.1 NONDISCRIMINATORY ACCESS TO BROADBAND INTERNET ACCESS TRANSPORT SERVICES

Unless restricted by preemptive Federal or State law, Grantee agrees to provide non-discriminatory access to its cable modem platform to providers of Internet access services, whether or not such providers are affiliated with Grantee, upon any of the following conditions:

(a) If by final order or judgment a court upholds or affirms the authority of any local government to require a cable operator to provide nondiscriminatory access to its cable modem platform to providers of Internet access services. For the purposes of this section, an order or judgment shall be considered final when a court of competent jurisdiction lets stand or affirms such order or judgment and any time for appeal or review of the order or judgment has passed.

(b) Should AT&T or TCI or their wholly-owned subsidiaries enter into an agreement that requires nondiscriminatory access to its cable modem platform for providers of Internet access services, provided that any requirement by the City would be subject to equivalent terms and conditions.

Notwithstanding the foregoing, nothing in this Franchise, nor the City’s failure to immediately require open, nondiscriminatory access as a condition of approval of the Resolution Approving Transfer of Control of the Grantee from TCI to AT&T adopted by the Board of Supervisors in File No. ____ shall prohibit or restrict the City’s authority to impose such a requirement on Grantee pursuant to any lawful authority and in accordance with any procedural requirements that may be applicable." "Section 25.1 NONDISCRIMINATORY ACCESS TO BROADBAND INTERNET ACCESS TRANSPORT SERVICES

(a) Unless restricted by preemptive Federal or State law, the City may impose a requirement that the Grantee shall provide non-discriminatory access to its cable modem platform to providers of Internet access services, whether or not such providers are affiliated with Grantee, upon any of the following conditions:

(1) If, by final order or judgment, a court upholds or affirms the authority of any local government to require a cable operator to provide nondiscriminatory access to its cable modem platform to providers of Internet access services and the City otherwise meets the legal and procedural prerequisites for the imposition of an access requirement. For the purposes of this section, an order or judgment shall be considered final when a court of competent jurisdiction lets stand or affirms such order or judgment has passed. Prior to the enactment or enforcement of any such requirement, Grantee shall provide with reasonable notice and an opportunity to be heard, including the right to present evidence on any findings made or required to be made by the City.

(2) Should AT&T or TCI or their wholly-owned subsidiaries enter into an agreement with a franchising authority that requires nondiscriminatory access to its cable modem platform for providers of Internet access services, provided that any requirement by the City would be subject to equivalent terms and conditions.

(b) AT&T will make high speed Internet access available (at speeds exceeding 200 Kbps) for any Subscriber in the Service Area who is unable to obtain high speed Internet access from another provider

By Supervisor Katz, that letter be sent to the City Attorney requesting legislation be drafted which would amend Chapter 39 of the Administrative Code (The Integrated Pest Management Program) to state that antimicrobials will be exempted from the Integrated Pest Management ordinance and that they will be addressed in the City’s EPP Program (Environmentally Preferable Purchasing Program; Chapter 21F, of the Administrative Code). Additional administrative amendments that will improve or clarify implementation of the IPM Program, as recommended by the Director of the Department of the Environment, should also be drafted.

By Supervisor Teng, that letter be sent to the City Attorney requesting legislation be drafted which would include skid marks in the City’s definition of graffiti and requiring graffiti vandals and tire manufacturers to pay for defacing City streets.

By Supervisor Yaki, that letter be sent to the City Attorney requesting legislation be drafted which would require disclosure of felony convictions of future appointees to San Francisco Board or Commissions who make decisions which directly confer or have a direct impact on economic benefits to private parties.
