The Board of Supervisors of the City and County of San Francisco met in regular session on the above date with President Barbara Kaufman presiding.

[Safe and Affordable Housing Preservation]
Ordinance amending Planning Code by adding Section 207.3 to establish a 36-month amnesty period during which an additional dwelling unit constructed without a permit prior to January 1, 1997 in a single-family structure in an RH-1 or RH-2 zoning district can be legalized without complying with all current code requirements, by amending Sections 135, 140 and 161 to exempt legalized units from open space, light and air and off-street parking requirements, and by adding Section 369 to impose a registration fee to fund enhanced neighborhood parking and open space and allow the Planning Department to recover its application processing costs; amending the Housing Code, by amending Section 353 to require inspection of a single-family structure in an RH-1 or RH-2 zoning district prior to transfer of title, and by amending Section 503(a) to allow lower ceiling heights in legalized units; amending Building Code by amending Section 101.3 to allow some exceptions from local code requirements for legalized dwelling units, by amending Section 107.5 to exempt owners participating in the amnesty program from paying penalty fees in legalized units; adopting findings under Planning Code Section 101.1; companion measure to File 115-97-13. There being no objection, the Board directed the Clerk to comply with the following requests: By Supervisor Medina, that City Attorney prepare legislation that would suspend the issuance of Cabaret Licenses for two years, within the area bound by O’Farrell Street to the south, Bush Street to the north, Van Ness Avenue (not including Van Ness Avenue) to the west, and Taylor Street to the east. By Supervisor Medina, that City Attorney prepare legislation to amend the Police Code to replace the title of the permit known as "Cabaret License" with one that more accurately reflects the permit’s purpose. By Supervisor Medina, that letter be sent to the Chief of Police requesting a report on the number of Alcohol Beverage Control Inspectors currently working in San Francisco, the number of liquor licenses in San Francisco, and the number of Inspectors the Police Chief feels are needed to adequately monitor these licenses. By Supervisor Medina, that letter be sent to the Director of the Human Resources Department to inquire if the Human Resources Department has a strategy to assess the departmental needs for bilingual staffing. By Supervisor Medina, that letter be sent to the Director of the Human Resources Department to inquire whether the goals of the City’s Affirmative Action Plan have been met. By Supervisor Katz, that City Attorney and the Art Commission review the feasibility of a requirement that preference be given to local artists for art purchasing/acquisitions due to construction projects in the City and County of San Francisco. By Supervisor Katz, that letter of inquiry be sent to the Director of the Public Transportation Department regarding the feasibility of installing turnstile fare collection gates that accept dollar bills, in addition to exact change, for MUNI riders at all MUNI stations due to the constant lack of operational change machines in MUNI stations (change machines continually out of service) and/or the possibility of MUNI adding working change machines. By Supervisor Leal, that City Attorney prepare legislation amending Ordinance 138-95 which requires the reporting of departmental overtime expenditures which exceed 5 per cent of total budgeted straight-time wages or which reach $100,000 annually or more in overtime wages. The legislation shall address the following issues: 1) that Departmental reports be submitted to the Budget Analysts’s Office (with copies to the Board of Supervisors) on January 2 and May 1 of each year; 2) that reports include a) actual overtime expenditures vs. overtime budget for the previous fiscal year and b) year to date overtime expenditures and projections for the current fiscal year; 3) that the Budget Analyst’s Office be required to report to the Finance Committee and the full Board within thirty days of the above referenced departmental reporting dates and 4) that the Budget Analyst’s report shall include a) the Budget Analyst’s ability to receive information from various departments and b) the status of overtime expenditures based on the information submitted.
