Mayor London Breed Extends San Francisco's Eviction Moratorium
On June 26, 2020, Mayor London Breed issued a new Order extending San Francisco’s eviction moratorium, details as to what this means for you are below.
On April 22, 2020, April 30, 2020, and then June 26, 2020, Mayor Breed issued Orders revising and extending San Francisco’s eviction moratorium. Per the latest extension – June 26, 2020 Order – a landlord cannot evict a residential tenant for a missed rent payment that became due during the eviction moratorium until January 31, 2020 or later (six months after the Mayor’s Order expires) IF:
(1) The missed rent payment BECAME DUE after March 13, 2020 but before the expiration of the eviction moratorium (currently, July 31, 2020) AND
(2) The tenant was unable to pay rent because of the financial impacts related to COVID-19.
Exceptions to the no-eviction Order: The Mayor’s Order does temporarily ban all residential evictions, including those in progress, but the Order does not protect evictions due to violence, or health and safety issues (rare, limited cases).
Timing: At the time of the missed rent payment, the tenant should notify the landlord and provide supporting documentation if they are unable to pay rent due to financial impacts of COVID-19. However, failure to provide notice and/or documentation to the landlord does not affect a tenant’s ability to claim the protections of the Rent Payment Extension as a defense to an eviction lawsuit for non-payment of rent. If an eviction lawsuit is filed, the tenant will be required to provide supporting documentation in court, although the court has discretion to waive this requirement in some circumstances.
What does “financial impacts” mean? For purposes of the Rent Payment Extension, “financial impacts” means a substantial loss of household income due to business closure, loss of compensable hours of work or wages, layoffs, or extraordinary out-of-pocket expenses. A financial impact is “related to COVID-19” if it was caused by the COVID-19 pandemic, the Mayor’s Proclamation, the Local Health Officer’s Declaration of Local Health Emergency, or orders or recommended guidance related to COVID-19 from local, state, or federal authorities.
Landlords and tenants are strongly encouraged to discuss payment plans for the tenant to repay all or a portion of the back rent. However, a payment plan may not shorten the six-month extension period or otherwise require a tenant to waive any of the protections of the Mayor’s Order.
Lastly, this past week the San Francisco-based Apartment List – a source that tracks month-to-month fluctuations in rents for cities across the United States – found that rents in San Francisco, as of today, are down 2.3% since March of 2020. Walk and Wave Wednesday In District 11
The District 11 office was informed by a group of constituents that every Wednesday at noon they meet at 1532 Cayuga (ask for Ms. Mary, the owner) and then head out as a group, by foot, to Alemany while holding homemade signs with friendly and community oriented messages (a simple, "hi" or "hello") and waving to those simply passing by or driving by.
This weekly activity is meant to encourage morale in a time of imposed isolation and to also provide space for people to socialize safely. Note, to participate you MUST have a face mask on and you must also comply with social distancing, and please remember to bring your own sign! Enjoy!
