I hope you are keeping well. Please know that my team has been working and will continue to work day and night to help our constituents. I am so proud of San Francisco for taking early and strict action to keep people distanced and stop the spread. We are here for you.
Tomorrow is April 1, and I know that many of you will be wondering how to pay your rent or mortgage, and what happens if you cannot make your payments in time. I am writing to get info out to you all about protections in place and pending for you as renters, homeowners, landlords, and small businesses.
Today, the Board of Supervisors passed a resolution I authored calling on California Governor Newsom to use emergency powers to impose an immediate moratorium on rent payments during the emergency and calls on federal legislators and the Trump administration to impose an immediate moratorium on mortgage payments.
Along with my main cosponsor, Supervisor Matt Haney, we put out the call to turn this into a nationwide movement , and so far have brought on partners in Boston, Los Angeles, Minneapolis, New York City, New Orleans, Philadelphia, Portland, Seattle, and St. Paul for a united message, and we know that housing advocates are working on this as well. It is clear to me that a moratorium on mortgage payments and cancelling rent must go hand in hand. We will keep pushing!
STEP ONE: Each time the tenant misses a rent payment, they must notify the landlord that they were unable to pay rent due to financial impacts of COVID-19 within 30 days after the date the rent was due.
STEP TWO: The tenant has one week to provide the landlord written documentation that the rent payment was missed due to financial impacts of COVID-19.
STEP THREE: If the tenant has followed the two-step process described above, the tenant shall have six months after the Order’s Expiration Date to pay the rent owed, before the landlord may attempt to recover possession due to the missed rent payment.
There is a statewide agreement with many lenders to offer mortgage payment forbearances of up to 90 days to borrowers economically impacted by COVID-19. However, you must reach out to your bank asap.
Under the Governor’s proposal, Californians who are struggling with the COVID-19 crisis may be eligible for the following relief upon contacting their financial institution:
90-Day Grace Period for Mortgage Payments
No Negative Credit Impacts Resulting from Relief
Moratorium on Initiating Foreclosure Sales or Evictions
